Antitrust Authority relations with the European Commission

The Authority is a member of the various advisory committees set up by the Directorate-General for Competition to acquire the non-binding opinions of the Antitrust Authorities of different member States with regard to draft decisions on Community cases relating to agreements, abuses of dominant position and concentrations, as well as with regard to any modification proposals of the Community rules.

Within the system of concurrent powers introduced by Council Regulation (EC) No. 1/2003 , the new regime for enforcing European Competition law entails close cooperation between the Commission and the Competition Authorities of the member States within the network of Competition Authorities (the European Competition Network). The Regulation specifically creates the obligation to inform and consult the Commission in advance whenever the Authority acts under articles 101 and 102 of the TFEU, and to assist the Commission when it conducts, or requests inspections to be conducted, within the national territory.
