Presidential Decree no.113 of July 18th, 2011 – Abrogation, following popular referendum, of Article 23-bis of Legislative Decree no.112/2008

PRESIDENTIAL DECREE no.113 dated 18 July 2011. Abrogation, following popular referendum, of Article 23-bis of Legislative Decree no.112/2008, converted, with modifications, from Law no.133/2008, and subsequent modifications, in the resulting text following Constitutional Court decision no.325/2010, regarding the methods of assigning and managing economically significant local public services.

Art. 1.

1. As a result of the referendum above, Article 23.bis of Legislative Decree no.112 dated 25 June 2008, containing “Urgent provisions for economic development, simplification, competitiveness, stabilisation of public finance and fiscal equalization”, converted, with modifications, from Law no.133 dated 6 August 2008, as modified by Article 30, paragraph 26 of Law no.99 dated 23 July 2009, containing “Provisions for the development and internationalisation of enterprises and the energy sector”, and by Article 15 of Legislative Decree no.135 dated 25 September 2009 containing “Urgent provisions for the implementation of EU obligations and the application of the European Court of Justice decisions”, converted, with modifications, from Law no.166 dated 20 November 2009, into the text resulting from Constitutional Court decision no.325 of 2010, is abrogated.

2. The abrogation described in paragraph 1 will take effect from the day following that of the publication of this decree in the Official Journal of the Republic of Italy. This decree, which bears the seal of State, shall be inserted into the official Collection of regulations of the Republic of Italy. This decree shall be obeyed and enforced by any person to whom it applies.
