Section 26 - Enactment with amendments of Decree-law No. 26 of 14 January 1994, containing urgent measures to support the film industry

1. In order to safeguard competition, the provisions of law No. 287 of 10 October 1990 shall apply wherever possible. The concentrations referred to in Section 16 of that Act shall be notified to the Competition Authority in advance, as required by Section 10 of the Act, whenever in any one of the main towns within film distribution zones (Rome, Milan, Turin, Genoa, Padua, Bologna, Florence, Naples, Bari, Catania, Cagliari and Ancona) an undertaking would hold a market share larger than 25 percent of the turnover from film distribution to cinemas and, simultaneously, more than 25 percent of the operating movies theatres.

2. The Authority receiving the notification pursuant to subsection (1) shall, acting in the manner and within the deadlines set by Section 16 of law No. 287 of 10 October 1990, assess at its discretion the cases in which the operation thus notified are to be prohibited on the grounds that they are likely to prevent or substantially restrict competition in the industry on a lasting basis.”
